Terms of Use
Last updated:
These Terms of Use (the “Terms”) govern your access to and use of the Inchaa website, mobile applications, business dashboard and related services (together, the “Services”), operated by Inchaa (“Inchaa”, “we”, “us” or “our”).
By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.
1. About the Services
Inchaa is a platform that helps project owners find, compare and connect with contractors, consultants and other construction professionals, and helps professionals discover relevant project opportunities.
Inchaa is not a contractor, consultant or party to any agreement between project owners and professionals. Any contract for construction work or services is made directly between those users, and they are solely responsible for its terms, performance, payment and compliance with applicable laws and permits.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract to use the Services. If you use the Services on behalf of a company or other organisation, you confirm that you are authorised to accept these Terms on its behalf.
3. Accounts
Some features require an account. You agree to:
- Provide accurate, current and complete information, and keep it up to date;
- Keep your login details confidential and not share your account;
- Notify us promptly of any unauthorised use of your account;
- Accept responsibility for all activity that takes place under your account.
4. Professionals and verification
Professionals who join Inchaa must hold, and keep valid, all licences, registrations, insurance and approvals required for the services they offer. We may ask for documents such as a trade license and may verify the information provided.
Verification helps build trust on the platform but is not a guarantee. We do not warrant the quality, safety, legality or timeliness of any professional's work, and project owners should carry out their own due diligence before entering into an agreement.
5. Acceptable use
When using the Services, you must not:
- Provide false, misleading or fraudulent information, or impersonate any person or business;
- Post content that is unlawful, defamatory, offensive or infringes the rights of others;
- Use the Services to send spam or unsolicited communications;
- Contact users for purposes unrelated to construction projects or services;
- Copy, scrape or collect data from the Services by automated means without our permission;
- Interfere with, disrupt or attempt to gain unauthorised access to the Services or their systems;
- Use the Services in breach of any applicable law or regulation.
6. Your content
You keep ownership of the information, documents, images and other content you submit to the Services. You grant Inchaa a non-exclusive, worldwide, royalty-free licence to host, store, display and process that content as needed to operate, provide and improve the Services.
You are responsible for your content and confirm that you have the rights needed to share it. We may remove content that breaches these Terms.
7. Intellectual property
The Services, including their design, software, text, graphics, logos and the Inchaa name and trademarks, are owned by Inchaa or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from them without our prior written permission.
8. Fees
Some Services may be offered for a fee or under a subscription. Any applicable fees, billing terms and cancellation conditions will be presented to you before you purchase, and form part of these Terms.
9. Third-party services
The Services may include links to, or integrations with, third-party websites and services, such as app stores and social networks. We are not responsible for their content, policies or practices, and your use of them is governed by their own terms.
10. Disclaimers
The Services are provided “as is” and “as available”. To the extent permitted by law, we make no warranties of any kind, whether express or implied, including that the Services will be uninterrupted, error-free or secure, or that any information on them is accurate or complete.
11. Limitation of liability
To the extent permitted by law, Inchaa will not be liable for any indirect, incidental, special or consequential damages, or for any loss of profits, revenue, data or business opportunity, arising from or related to your use of the Services or any agreement or dispute between users.
Our total liability for any claim relating to the Services will not exceed the amount you paid to Inchaa for the Services in the twelve months before the claim, or AED 500 if you have not paid anything.
12. Indemnity
You agree to indemnify and hold Inchaa harmless from any claims, losses and expenses, including reasonable legal fees, arising from your breach of these Terms, your content or your dealings with other users.
13. Suspension and termination
You may stop using the Services at any time. We may suspend or close your account, or restrict access to the Services, if you breach these Terms, if required by law, or to protect the Services and their users. Sections that by their nature should survive termination will continue to apply.
14. Governing law
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any dispute arising from them will be subject to the exclusive jurisdiction of the courts of Dubai, unless applicable law requires otherwise.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date above and, where the changes are significant, notify you through the Services or by email. Continuing to use the Services after the changes take effect means you accept the updated Terms.
